What Happens After You Are Arrested for DUI in Miami

Being pulled over under suspicion of DUI can be an unnerving experience, transforming an ordinary day into one filled with anxiety and uncertainty. Knowing what to expect and how to act can significantly influence the outcome of such an ordeal. It’s crucial to stay calm, cooperate with basic requests, and remember your rights, including the right to legal representation.

Upon suspicion of DUI, a police officer might ask you to undergo a field sobriety test or to breathe into a portable breathalyzer. In Florida, while you have the right to refuse these tests, such refusal can lead to immediate license suspension due to the state’s implied consent law. If the officer believes there’s probable cause, you’ll be arrested and taken to a police station for further testing, which could include more sophisticated breath, blood, or urine tests to determine your blood alcohol content (BAC).

After processing, you might be held in custody for a minimum of 8 hours—a cooling-off period mandated by Florida law. However, release could be sooner if you sober up, show no signs of impairment, or your BAC drops below 0.05%.

The aftermath of a DUI arrest can be daunting. The charges you face, the potential for license suspension, and the prospect of fines or jail time are not only overwhelming but can have long-term impacts on your life. That’s why securing experienced legal representation swiftly is paramount.
